Terms of Service

1. Acceptance
By accessing or using the Service, you confirm that you can form a binding contract and that you accept these Terms and our Privacy Policy. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation, and “you” refers to it.
2. Definitions
- Customer — the agency or business that subscribes to the Service.
- Authorised User — a person the Customer permits to use the Service (e.g. CEO, managers, agents).
- Customer Data — leads, contacts, listings, messages, sales and other data submitted to the Service by or for the Customer.
3. Accounts & eligibility
Accounts are provisioned for business use. You are responsible for the accuracy of your registration details, for keeping credentials confidential, and for all activity under your account. Notify us promptly at hello@brokleads.com of any unauthorised use. You must be at least 18 years old.
4. Subscriptions, billing & demos
- Paid plans are billed in advance on a recurring basis at the price and seat capacity shown at purchase. Unless stated otherwise, fees are exclusive of applicable taxes.
- Subscriptions renew automatically for the same period unless cancelled before the renewal date. Cancellation stops future renewals; it does not refund the current period except where required by law.
- Demos and evaluations are provided “as is” for assessment only and may be modified or withdrawn at any time.
- We may change pricing on renewal with reasonable prior notice.
5. Acceptable use
You agree not to, and not to permit others to:
- Use the Service unlawfully, or to send spam or unsolicited messages in breach of anti-spam, telemarketing or messaging-platform rules (including WhatsApp and Meta policies).
- Upload malware, attempt to breach security, probe, scan or disrupt the Service, or bypass usage or seat limits.
- Reverse engineer, resell or provide the Service to third parties except as expressly permitted.
- Infringe intellectual-property or privacy rights, or upload data you have no right to process.
We may suspend access for conduct that violates this section or poses a risk to the Service or others.
6. Customer Data & ownership
As between the parties, the Customer owns all Customer Data. You grant us a limited licence to host, process and transmit Customer Data solely to provide and support the Service. You are responsible for the accuracy and lawfulness of Customer Data and for obtaining any consents needed to collect and process leads and contacts. We process personal information as described in our Privacy Policy.
7. Our intellectual property
The Service, including its software, design, branding and content (excluding Customer Data), is owned by BrokLeads and its licensors and is protected by law. We grant you a non-exclusive, non-transferable right to use the Service during your subscription in accordance with these Terms.
8. Third-party integrations
The Service can connect to third-party platforms such as Meta and the WhatsApp Business Platform. Your use of those platforms is governed by their own terms, and their availability is outside our control. We are not responsible for third-party services or for changes they make to their APIs.
9. Confidentiality
Each party may access non-public information of the other. The receiving party will use it only to perform under these Terms and protect it with reasonable care, except where disclosure is required by law.
10. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or fully secure.
11. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total aggregate liability arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve months before the event giving rise to the claim.
12. Indemnification
You will defend and indemnify BrokLeads against third-party claims arising from your Customer Data or your use of the Service in breach of these Terms or applicable law.
13. Term, suspension & termination
These Terms apply while you use the Service. Either party may terminate for material breach not cured within 30 days of notice. We may suspend or terminate access for non-payment, security risk or violation of Section 5. On termination, your right to use the Service ends; you may export Customer Data for a reasonable period, after which we may delete it.
14. Changes to the Service or Terms
We may modify the Service and update these Terms. Material changes take effect on the “Last updated” date, and continued use after that date constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the Islamic Republic of Pakistan, and the courts of Lahore will have exclusive jurisdiction, without regard to conflict-of-laws rules and subject to any mandatory local consumer protections.
